Default Carpool ticket

I just got a carpool ticket by CHP on the 605 north bound in Whittier. Does anyone know if carpool violations is a moving violation counting as a point on your record?

A carpool ticket meaning you were in the carpool lane without any other passengers in your car?

I got one here in VA, it doesn't go on your record in VA. Apparently it is like have a busted tailight or what not, it is just a fine. Hard to get out of, but GL!

They've raised the price, like $341 now... and it is a point on your record.

Fight it, say you swerved into the lane to avoid a accident and didnt want to violate the double yellow line law so you stayed in hehe.

Andy when I was in traffic school the instructor told me it was NOT a point on your driving record. It seems rather weird that it would not be a moving violation but he said it was not. Oh and just so you know I am in SoCal not NY anymore.....Ed

i went to traffic school recently, and a few people in the class were in it because they got busted on the carpool lane. in california, it is a point on ur record. if u plan on fighting it, here's my 2 cents:

Try to get an extension or postpone the trail date as long as possible. Certain districts allow you to get 2 extensions, lasting a month per ext. after u exhausted the delay, plead not guilty. wen the clerk issues you a date to see a judge, a few months should have passed from the date you received ur tix. then wen u visit the judge, plead not guilty and the judge will give you another time to see him with the officer. hopefully, with all these delays, the cops schedule will conflict with the actual trail date. if thats the case, and the cop is not in court, you automatically win. but you still have to pay court fees, which shouldnt be too much. it worked for me, maybe itll work for u. good luck.

+1. That's your best chance beating a ticket on your own.

Thanks for all your help guys. Ive been getting mixed opinions about this. My main concern is that point. People are telling me it is a point and other people are telling me it is not. My co worker here just went to traffic school this past Saturday and asked the instructor the same question and he had replied that it is not. The vehicle code on the ticket is a 21655.5B which I heard that is not a moving violation, any vehicle code that is 217 or higher is a point. Honestly, I cant see why it is a moving violation, I wasnt speeding, I wasnt tail gating, crossing double yellow lines, etc. I was just in the wrong lane and I cant see how that is justified as a moving violation. But we'll have to see. Im definitely going to extend the court appearances as long as I can and then fight it. Ill have to ask my cusotmer who is a police officer on it as well to see if it is a point. I just wish someone had a solid answer on if its a point or not.

If it is not a moving violation, then I can use the same argument for driving into wrong way traffic. Technically it is a moving violation.

Actually if you drive into the opposite direction of traffic, you would be crossing double yellow lines which would be a moving violation.

Call the DMV, they will tell you if it counts as a point. Traffic school will, of course, clear the point. BUT check your DMV record after the ticket and T. School posts to your record Some people attend traffic school and DMV fails to clear your record.
PS: Postponing your court date, twice CAN help. If your cop shows up DO NOT fight it you will loose, just tell the court clerck that you want traffic school.
SO. Ticket $300.00, traffic school $40.00.
Will your insurance go up MORE than the cost of all court costs?
Good luck.
