Default Anybody ever sue a dealer?

Anybody ever sue their dealerships service Dept. for damages done to their car, like Scratches, dents, chips, dings, rips, cracks, tears in fabric, etc that were caused by them, after they denied and or refused to fix what they did?

Once i took my Z in for minor work and they happened to get the front bumper caught on the automotive lift boom arm. the front bumper came ripping off.....

They did a poor job painting it.....then i let the General manager know and he had everything taken care of......they hid it from him at first....

He made sure to send the new front bumper out and get it painted by a good shop, it matched perfectly...

i guess i couldnt complain after that.........but i was sooo mad!

You can sue anyone for any reason. Just file a suit in small claims court. Its about $25.

The burden of proof will be on you. You must prove with a preponderance of evidence that the dealer caused the damages.

+1, proofing that the dealer actually caused the damage can be very tough. And imagine the number of sleepless nite you will have preparing for the court day for a hard to win case. Have you tried talking nicely to the general manager or the owner of the dealer 1st?

I'm going to take my car in for an 04' recall but im too scared that they might screw something up... Seriously though wth happens after they actually made some screw ups on it? And then they deny it...

No, not for those reasons, but my dad sued them for blowing up his Z32TT motor with less than 60k miles.

Hehe I have my a$$ covered this time because this time when I dropped it off, I had him sign the exploded drawing picture of the vehicle with the areas of known damage noted on the diagram. After he and I did the walk around and before I left the lot, I had him him Xerox me a copy of the drawing with his and my signature on it, with the known defects. Three of those four defects were caused by them in the first place.

If I find ANYTHING wrong with the car, other than what's listed, it's on his a$$ not mine because he signed and agreed to what's on the list/drawing. That is all the proof I need.

If there is any painted surfaces that are damaged again this time, they're repainting the whole damn car or else they can give me back my $30,000 and drive my Z straight up their a$$e% burning, leaking oil and all!

To my Knowledge they haven't done anything to it yet but when I pick up the car later this week, if there is damage done again, I will have to sue this time, unless they REPLACE what they damaged with brand new parts, including my new wheels and exhaust if they fug those up.

On my last visit, they broke off the rear emblem and put a 12 inch clear coat scratch on it. They never even put a tool to the car on that visit. They just dropped in some oil dye, let the engine idle for a few minutes, put it on a lift, washed it and whala, broken emblem and 12" scrtach. When I told him about the emblem on the day it happend, he said he would order a new one and take care of it and said he was sorry.

When I dropped it off today the same servce manager said, "a rumor has it that the emblem was broken before you brought the car in". I wanted to reach over the counter and feed him my fist. He did say that he will replace it however but made sure he made it sound like I broke it and that he was just being nice by replacing it. Mother F$#ers.

If he didnt replace my emblem I would just go down there at 6am on a Sunday morning with Dental floss and take my own!!! And maybe leave them a nice 12" racing stripe on a couple of their Z's

The good thing is that you documented that. Getting it in writing that they damaged your car.

With these problems and the oil consumption issue you're having I would contact a lawyer and pursue the lemon law. Sounds like you'd have a strong case. Not just on the damage but on the engine issue.

Did they replace your engine? or are you waiting for one?
Even though i'm not taking the engine replacement I've found out they're on backorder anyway. Even the service manager said there are non available in the US and they have no scheduled date so it could be a couple weeks or a few months.

At this point, instead of getting angry, I would have shown him the document that you had previously which indicated that it was broke during your last service visit. Kind of hard to dispute that.

Thank Krist for miricles.

Initially, They told me that they were going to have to take the engine out to fix the leak, that they said looked like it was coming from the oil pan. I always thought that seemed odd because I could SMELL hot smoking oil burning off on the headers or something and I know the oil pan doesn't get that hot.

Long story short, The leak was caused by some threaded hose L shapped Gizmo next to the timing cover, that wasn't reconnected right and they were able figure that out before they took the motor out. So they never did take it back out. THANK GOD!!!!!!!!!!!

I actually got the car back with no further damage (dents, scratches, chips, broken emblems etc,). Guess I will make them sign their lives away everytime I need to bring the car in for anything, even as simple as an oil change. Don't think that dealer will see me anytime soon because I'm taking my car elsewhere in the future.

It's really too bad because they were friendly and coopertative, right up until they started damaging my car and then trying to blame it on me. F*&% You Santa Rosa Nissan!!!

After a few months now, I FINALLY got my Pop Charger back in and WOW I forgot how sweet it sounds at 5K+

Glad to hear everything is fixed. I'm also glad that your oil loss was due to a bad hose and not something internally. I bet you're happy to get your Z back on the road without any more worries

Damn right I'm happy now.

I have a feeling the mod bug will be biting again someday in the future. Hmm lets see it's 7:35 right now
