Default Warrantee help

I bought my 2003 350Z on 4-01-2006 and the lady who had the car before me had already purchased the 100k mile exended warrantee. The dealership decided to do all the paperwork on the car since it was a lease. So technically I bought it from the dealership but negotiated with the previous owner. The dealership told me that the warrantee was transfered and I had already signed for all the paperwork on the tranfer. And so did the previous owner. So I assumed everything was good.

Now, fast forward to today. I need a window motor repair, I take the car in and they say I am out of my warrantee. At 59k miles. They tell me the warrantee is still under the previous owners name. And that I can't use it. Even though she doesn't own the car. Now Nissan is telling me that it is too far out from the original purchase to transfer the warrantee even tjhough I have all the signitures from me and the original owner. This is one of the major reasons why I bought the car. I didn't want to pay for all the stupid little things that go wrong on it. Is there anyone else that has had this happen to them or someone that works fo nissan that could help me.

dealerships always try n f*ck you over... if you have the signatures from the other owner.. you shoudl be fine.. plus the dealership should of given you some type of receipt for the warranty..

Thats the thing, I have no reciepts from the warrantee transfer. If so it would be easy. I guess its my fault for not checking everything but they gave me about 100 pages worth of crap and a lot of it was me signing things. I remember signing the transfer paperwork. But I have nothing to prove it. Plus we spent almost the entire day at the dealership when it was supposed to be only about an hour. So by the end I was tired. And the warrantee was one of the major things I was trying to get straight with them and when they finally said it was good I believed them.

(me assuming)

If there was a warranty bought on the car and the car is within the mileage limits, shouldn't the warranty still be alive?

Nissan warranty is worthless. Its just like health insurance where they deny for no good reason. You are in the right, you will prevail, just keep escalating. Try working with the dealer, Nissan North America, BBB autoline, and if all else fails, small claims.

I have the 100k mile warranty and it hasn't been worthless. If a dealer is giving you a hard time, go to a different dealer.

Every Dealer says the same thing. When the run the vin the warrantee shows up in the previous owners name and they won't touch the car. I am working my way up the chain right now though. Every day I get to sit on the phone for about 2 hours and then they transfer me to someone higher.

Transferring warranties is always weird. I've been told a warranty can't be transferred, only cancelled and resigned up. Crap like that.

With the Nissan Extended I have heard from many people that it IS transferrable. Paperwork is involved though. If the dealer is the one that screwed it up and you have something (anything?) in writing about the transfer...I would ask to speak with someone in their Finance dept. It was clearly their mistake. But if the contract is sketcky and is worded weird or doesn't mention the ext warranty then you're prob out of luck.

And as far as warranty receipts...I'm not sure I have anything proving I have the Ext Warranty. I think they just place it on the VIN. You just need something that says they were supposed to transfer it for you.

Just to give an update. After sitting on the phone for about 4 hours. I finally got it settled. I had to eventually be transfered to the reginal dept and they were able to help. What I need is the transfer of ownership paperwork(bill of sale), Warrantee transfer paperwork, and a copy of the 128pt inspection that I had when I bought the car, and a $25 check. They said that it would take 4-6 weeks to transfer. I'm not happy about the wait but at least it is getting settled.

I'd take the dealership into small claims. They can't use an attorney, they have to go themselves. Sue for your time, and phone calls. Since it will be a few hundred, they probably will just pay you rather than risk that you just happen to have the media there in court.

I once had a "problem" with Burlington Railroad, when I first called "home office" he just laughed and told me to F off. When I had them served I get a call and am told that I can't sue them, I said see you in court, you were served. The day before the trial, the guy that told me to F off , calls and says well, we will send you a check, but not any interest or fees. I said you know what, "tomorrow, I'm going into court and I will win and day after tomorrow, you will be laying track to my house and deliver me a train". The guy starts laughing and says " OK a$$hole, a full check will be Fedexed out today.

I just had to do the same thing with the transfer, but the dealership claimed that they couldn't help, so I called NNA and they helped with the process. I haven't gotten the transferred stuff yet as the 6 weeks haven't passed, but I've been told that it will happen.

Where did you hear that silly piece of misinformation???

Anyone has a right to be represented by any attorney in ANY legal proceeding, even those evil car dealers.

That stinks, my window motor broke while still under manu warranty, lucky I guess. So what will you do, wait 4-6 to get the window fixed under warranty or do it now out of pocket?

Well, in WA, attorneys weren't there in the past. I stand corrected and shouldn't have used the word "allowed". I just looked it up and they have added mediation before a trial. And it says in the court rules that:"Attorneys and paralegals may not represent the parties at mediation." Which would indicate that they can assist you if it proceeds to court. Having been there many times, there was never an attorney anywhere near that court room, maybe it was just that with the situation having to be a small amount of money, (now raised to $10K), attorneys just wouldn't touch them. Duh.

Generally speaking, you seldom see attorneys in Small Claims Court. that's why individuals use Small Clains Court; they do not NEED attorneys.

But all parties to a suit in Small Claims Court have RIGHT to be represented, if they so choose.

I'm just gonna wait because my Pioneer Avic Z1 was sent in under warrantee repair also and won't be done for about 3 weeks. Plus I'm building a custom box in the hatch so the wait doesn't really bother me. By the time my warrantee is transfered everything will be coming together. Plus its not my daily driver.

if someone from nissan that delt with warranties actually was on this site, there would be a lot of denied claims
