Well, local law enforcement, well for that matter any law enforcement agent/officer who has not passed the training/academy for immigration enforcement cannot determine alienage let alone deport them. Also, most are too overworked to the point where they do not bother to hassle with doing turn overs to Customs and Border Protection. Unfortunately, a lot of illegal immigrants do get busted for DUI (multiple times) and drug use or dealing before they finally get deported.

However, illegal immigrant, tourist, or US citizens all have equal rights and protection in terms of the law. That is why so many people want to live here, individuals are given equal protection under the law. Please don't think this means they should have equal access to social security, medical care, etc...

More than likely the judge will drop the charges against you and give the guy some minimal time (days in the county jail) and probation without ever even considering turning him over to immigration officials. I would definately get an attorney just in case.
