i broke them once on fontana speed way. they replaced with out arguing

I'd say your chances are slim to none. Axle failure could easily be possible - once. Twice - they're going to suspect and claim abuse. I would at least expect an argument from the dealer/Nissan.

you don't need extra hp to break axles, like you said, you were doing a burn out. That's abuse to the car.

Like I said, the first time you can tell them just about anything. The second time a lot harder. I'm not sure what kind of "normal" use your could claim that would have caused them to break.

 

Anyone who doesn't know what they are doing can break a stock axle...

 

Never heard of breaking axles just from burnouts but from 6k rpm clutch drops thats possible.

OP - The answer is yes, you CAN be denied warranty if the dealer deems fit. From your explanation, I'd escort you to the sales department of another dealership.

They would have to show proof that it was abuse that caused it to happen, if you havent told them what really happened

 

this is such an inexpensive claim that they will not likely bother. but if they do not much can be done...suspecting abuse wont do jack and unless they can prove it with evidence you got nothing to worry about.

You're confusing this with aftermarket warranty claims. The dealer/Nissan has to prove that an aftermarket part caused a problem to deny you warranty coverage for that problem.

In this case, by virtue of the rapid failure of a part that under normal wear and tear should never fail, they will assert that it had to be abuse that caused the failure. His only hope is to claim and prove that the previous axels were defective, installed improperly or there is some other fundamental problem with his car that is causing them to fail prematurely.

Agree. As a service manager I would tell you no. Twice in two months is not a material deficiency, its abuse. Sorry.

EDIT: Besides I don't think you want OEM rear axles anyway.
