yeah, i hate this BS. I talked to my bank and they said to talk to the dealer. i talked to the dealer and they are trying to sort everything out. and i would love to make the z a track only car, but i dont want to have paid 11K on a car that if i tried to sell couldnt even make 4 out of. especially since i have only been able to drive it since september. from what i have read and researched is that its a straight forward case. if the issue isnt dealt with and the title doesnt come out clean. i can decide to keep the car (no refund) or give the car to them with a full refund plus they have to give me a car in place of greater value. (main source is a friend of mines parents who are both lawyers, and have dealt with issues like this.) I will go with returning the car and having them give me a car, and just selling it and either getting myself another Z or something in the nissan family.

Dude how are they going to give you a full refund
and a car of greater value. Nobody gives anything
for free.

the bank is who he owes. He paid the dealership already.

get a g35, same effing performance with more room and utility. cheaper insurance too!

you can track your next Z, youre young, dont rush have a track car until you own a home, for when you crash your track car (in which you will) you can tow it home with your big truck and trailer, park the wrecked Z in the garage, then jump into your daily Audi A4 to go to work to make more money to fix your track car.

Check your bill of sale that is your legal contract. The car they give you is
not the one you picked. And will probably be worth less, get a Z like you
wanted and bring with you one of those lawyer family friends. They cheated
once they will try to cheat again. The Dept. of Motor Vehicles will give
exact status of Title. You can check online too. Between a G and a Z.

Damn, $11k on a 2 year loan? Good luck though, should be cut and dry if the paperwork is right. I got had on my first car, but luckily got out of it unscathed.

Multiple reasons,
one, they sold me a car with a nasty title. there are laws that say they have to tell me it has a salvaged title, or a branded title, or anything that wouldn't make the title completely clean. they didnt, i have all my paperwork. etc.
two, If i wanted to i could take them to court, and easily win, they would have to pay all of my legal fees. That would give them a very bad rep and could possibly even shut them down. so their way of "keeping you quiet" they basically give you anything you want. to keep everything out of court, because they know they will lose, they would rather lose a $40K car instead of losing an entire car lot because they sold a car with a bad title.

so yeah. I will more than likely be getting a new car in the next week or 2, hopefully its an evo (since its a mitsubishi dealership) if it is, i will drive it for a few months then sell it and make a large profit. buy a cheaper car, then pay off my school so i can finally go back and get my education and get a real job =) how does that sound? lol

I don't understand why people put so much faith and credibility on Carfax. It's only a service that's hyped up to take your money. A waiver can be challenged in court, so relying on Carfax is a crutch.

Like others have mentioned, if there's legal language on paper stating the title is clean and the dealership signed it, then you have a good chance of winning the case. However, if you knew the title history and bought it anyway, then that will complicate matters. I'll assume your original post is true in regards to not knowing the history of the car.

Good luck with your case. I hope you come out smelling like roses.

Sounds good I hope you come out on top. They usually dont
give you anything you want. Unless they have a bad record
or criminal offenses. I dont think on one car they will lose
their dealers license. I been through these situations and have
seen it in others. Unless you could prove fraud they might say
negligence in which case the court wont penalize them as bad
as you think. It might not even be worth sueing for that amount.
Just giving you some ideas these guys know every trick in the book.
So have everything in writing. Just get as new and expensive a
car as you can. If you break a little above even call it a day and
get another Z. $40 for $11 Doubtful.

Carfax is only good if they actually report the car being in an accident. If the car was bought from a dealer and the owner never came back to a dealer again... it would have a clean car fax.
