I am claiming for a full refund but Nissan have offered to replace my engine.
I have copied quotes from this thread with the similar problems that you guys are having but judge wants more info and this is were I need your help again.
Could you guys please write up a short letter outlining the oil consumption problems that you have had but in your letter you must state you full name, the car you drive,
date and address. I know Im asking for alot but specific letters from people with the same problem is what the judge wants to see.
If you could email such a letter i would greatly appreciate it.
A big thanks to those members who have already done so.

I seriously doubt Nissan will replace our engine with the HR.. for one it would require replacement of the ECU and it sounds like the transmission, exhaust and other components as well.
Thanks for the support guys. Friday is the big day. I'm ready.

got my lids! the luck is still going!
Well guys after reading this thread a couple of weeks ago i started checking my oil levels and i just hit 2,800 miles on my 06 Z it does not look like it is consuming any oil. I will wait and monitor this after the first oil change to see if anything changes. Hopefully it doesn't!

okay my update is as follows, nissan is very aware of the issue but doesnt know how to track the models with the issue . So they cant issue a tsb or anything until they can find the route of the issue and not cost themselves alot of money and headace. I currently have been flagged as having oil comsuption issues and right now am sht out of luck because even if you get a new motor the percentage right now nissan cannot determine wether you would get a engine with the same issue . Since this is a revup mt issue. The way it was expalined to me was upon a down shift the vacuum sucks in oil through a faulty ring which is allowing the engine to burn oil more so then is normal comsumption. Why is it a revup specific issue ...its because of the manufactering plants where these engines are made which are from a diff line then the reg DEs ala HRS. There is no rememdy now , and its def mechanical not ecu related. As of right now, i have no instructions but to just deal with it for now until there is a rememdy from nissan and though i have been treated extremely good and very professionally which i duly appreciate. Its very odd to see such a event happen without the manufactuer coming out with a rememdy upon noticing the issue. Very werd for them to know somethings wrong not know how to fix it. Especially a japanese manufacter. But ....im not sure of how the lemon laws work but as of now im gonna deal with it for a mnth and if nothing turns up i will have to escalate it due to me owning a car thats defective i mean. Really my 04 was bullet proof my revup isnt ..Not really something u wanna be concnerned with on a Stock NA car on a trip is your oil consumption.
But i must say my dealership is treating me very professional and excellent with reguards to this delimea so i have nothing to bash them but..has anyone come to agree ment with this lemon law process . I am going to give it a month. Before i do anything to that nature. Not because of the serivce becasue its been awesome but...because this is my daily driver.
BTW AUTOS are not effected by this issue.
The kicker is even more serious but im not going to get into it. Just realize that the 35 annvs was suppose to be a one off. Mass producation sucks.

I am not sure I truly believe the faulty ring issue that they are hanging their hats on. The Altima had the same issue with rings and they issued a recall very quickly and had things under control.
Lemon Law should really be easy if Nissan is admitting they are at fault and can't fix it. I do not know why there is so much resistance. If they take care of the people that are noticing this, then they could have kept it very quite. At this rate, this will become a huge black eye for Nissan and it will cost them a lot more than just doing the right thing.

Good Luck Tomorrow!
I just came across this thread yesterday, and I am really worried now, this car is my everyday driver and to be honest I drive it a lot in the 4500 + range because if I wanted a car had to keep in the low rpms I would have bought a kia or some crap like that, This is a freakin sports car it is supposed to be driven hard and thats the rule that I have been following
. I have had the car for 2 months now and have 5k on it. I changed the oil myself at about 3500 miles and used Mobil 5w30. I didn't notice how much oil drained out because my pan already had some in it and I didn't figure I would have to worry about it burnin oil. I am going to start keeping a very close eye on it.

OK. Just got done with the Tech Specialist Nissan sent out. Basically same thing that bofa went through, but I have some further details. I am going to let them put the new engine in to see what happens. Consider it a public service attempt for all the folks having this issue.
Also, I am just extremely curious if this will fix the problem.
--- Warning! Contradictory statements coming!
1) Nissan is admitting that my vehicle has an excessive oil consumption issue
2) Nissan is NOT admitting there is a flaw in the engine design
3) Nissan is stating that the consumption is due to driving style
4) Nissan is STILL stating that when you downshift, oil is blowing past the rings
5) In Addition, Nissan states that when you get off the throttle, the same thing will happen as when you downshift
6) Nissan has new engines for people with this problem (re-read #3)
7) These new engines have new rings and new pistons (re-read #3)
8) Nissan will give you the extended warranty - 7 / 100,000 along with the engine replacement
9) When asked why my car consumes so much oil and the 05 never leaves the H mark, answer was "Well, the 05 does not have the anniversary engine in it" (re-read #3)
10) Nissan states that the engine should not burn any additional oil during a break-in period.
11) Nissan is not going to be releasing a software fix for this.
So, I wait for them to call to schedule the replacement. They still only get 10 days to get this going, so if they call back and say "Sorry, we lied, engine will not be in until June" I will be proceeding with arbitration.
I did not expect them to say that they had the engines in the US and figured they would say they were still months away from a fix.
The interesting point here is that there is no indication that Nissan is going to do anything for people that do not complain about it.

I have an update as well. Had my engine replaced on March 27th, 07. At 600 miles, it needed 2 qts to top off. This past Sunday, I replaced the oil at 1500 miles and it was down 2qts again.
I placed a call to both Nissan corp and my dealer to inform them. I was told by Nissan corp, "we can't can't take your word for it, you must take back to the dealer for another oil consumption test". OK, I will do it again.
This is my second engine. It is consuming at exactly the same rate as the original. (odd) Again, I have to pull the spacer (probably 5 or 6 times now) before I start this process.
I have continued to foreward information to the media in hopes that someone will pick up this story. As of yet, no response. I will continue to do so.
I have committed to waiting until June 1st. That my deadline. If there is no resolution by then, I will begin the Lemon law process.
By the way, Nissan has admitted to the problem Verbally. I have yet to see anything in writting. The rep said something to me the other day which I find ironic. She said " What reason would Nissan have for lying about the fact that we are doing everything possible to resolve this problem". It was at that moment that I became pessimistic about this being resolved.

Just got out of arbitration a little bit ago. I will probably not have a decision until late next week or the following week. Nissan sent two guys to face off, however they were nice and seemed knowledgable. Both sides were well represented, the arbitrator inspected the car (oil was low 1 qt again), we argued our sides and we'll see how it ends up. Thanks for all of the support guys.
BTW, I can confirm that essentially everything dbasal posted above is true. On #6 though, the new engines still aren't available and I couldn't get any solid commitment as to a date... estimate 45 days or so for the first batch. That leads to his last note... NNA only knows there is a problem if you present it to them and won't do anything until you follow through with the issue.

What type of information did you provide to the arbitrator?
Interesting in the difference of timeframes. I was worried he was blowing smoke (not pun intended), but since they are going to be getting back to me, I am sure I will find out soon enough.
They are still on the 10 day clock. If the engines truly are not here, then I will continue to arbitration as you did.

I do find it interesting that this "rev-up v2" is supposed to have new rings AND new pistons. Again though, verbally, as you mentioned.
So far it has been a lot of talk and no action. I've now given these folks every chance to deliver. I certainly expect them to live up to their responsibilites, but after reading bofas message, I am not so optimistic now.
Either way, 10 days and counting.
i think thats bs about the pistons. The pistons in all the revups are the same.I cant see them releasing a revised revup engine unless they are mail to order becasue of this issue. I bet you that upon inspection of those pistons they probably will have the same part number. The rings i can believe simply because the ring was defective to begin with so maybey they can jus tmodify or repleace it with a more strengthened unit. The revup already uses diff pistons from the reg DE i highly doubt there gonna make one off pistons for our engines. I actuallly got called back from NNA and they told me that they will get back to me with a conclusion. So Im waiting that. I would love for nissan to have special motors manufactered for these revup problems i mean alll thats required is a nice crate engine made and tested not to have these issues. Since the issue is stated to happen on a down shift maybey there engine testing inspections didnt catch this becasue testing didnt include long term driver and maintance testing on the revup since its really a limted edtion motor considering its term and usage.
They asked me what i want in terms of resolving this issue and i said a 07 Z or a revup motor that doesnt consume oil lmao. Well see how this turns out.
