Lemon Law Results!
As many of you know I've been battling NNA for a few months and I finally received the arbitration decision. I wanted to start this thread to share my results and give others a place to share their stories and to assist people with their questions.
As a little background, my issue was with 06 oil consumption at an excessive rate. I began with completing oil consumption test intervals and consistently consumed 4 or more qts of oil in 1000 miles. I used the BBB Auto Line to assist with the Lemon Law process and they were great! We arranged the final repair attempt and NNA had nothing. They made a cheesy offer to settle (a warranty package... lol) and I declined. The final step was arbitration.
Arbitration was an interesting process. NNA sent a master tech and a regional rep to represent their side. I was representing myself. The BBB coordinated the Arbitrator and the meeting in their local office. After taking turns presenting our sides the Arbitrator asked to see the car. (He really liked it by the way.) He asked me how far I had driven it since the last oil change and it was just over 300 miles or so. He asked the tech to check the level and it was 1 qt low... lol. We returned, presented final arguments and that was it. It took about an hour. Two weeks later I got my desicion! The entire process took about 8 months, but the once I contacted the BBB it took about 4 months.
The arbitrator ruled in my favor and NNA will have to repurchase the vehicle from me within 30 days. I will walk away with a pretty decent chunk of change and happy to be away from the oil consumption issue.
Thanks to all of those with the support along the way. I still really like the Z but this was a bit much and will prevent me from purchasing another any time soon.
*Note, this doesn't mean everyone will have the same results. Every case is considered individually.

Yeah 8 months of driving to the dealership and dealing with this stuff was a pain. My only other options were to let NNA lead me around by my nose or to trade it in and take a $5000+ hit. With some patience and a little diligence, I came out with almost all of my money back.
The most consistent issues are with the 05 and 06 models with the REVUP engine and 6MT.
Anyone else with lemon law stories? I spoke with a few while working through my problems. Good guys. Hopefully they're still around to chime in.

Bofa, Good to hear it worked out for you. I am even happier for you that you won the arbitration fair and square. If you can share, I am courious what reason NNA used for their defense? It seemed a no brainer looking from the outside that they shouldn't have a case.

Kind of sad that NNA knows of the problem and still makes you jump through hoops to get them to warranty the problem with no compensation for 8 months of clear loss of time and inconvenience.

wow i didnt know it takes that long. i just filed for the lemon law with my lawyer a month ago. th 14th of this month will be one month. so we will see what happens. my case agianst nissan is that they have had my car for over 30 days if you count all the times that it has been to the dealer. plus im going in for another oil consumtion test which will be my 3rd one and for my second gear grinding and if they change the tranny this will be the second time they will be changing my tranny. so wish me luck. if this goes through i will be getting back alot of money which will help me cover some debts.

I am curious. How did the tech check the oil at the arbitration ? did the dipstick show it as 1qt low or did they have to drain it and test ?
I have put about 2000 miles on my 06 Z so far. I checked the level a couple times along the way via the dipstick and have noticed no change in level (both times when car had not been driven over night). I am just wondering if this is an acurate enough test or if all 06s should just be brought in for a consumption test?
Anyways sorry to hijack the thread. I am glad you won the arbitration and received compensated for your car!

That is absolutely appauling to have had that dragged out for such a long period of time given the obvious oil burning issues.
