I bet Nissan of North America would be interested in hearing how thier manager took money out or thier pocket selling it to the dealership for Grand Touring model value when he originally paid Touring model pricing for it. That's fraud on his part my friends, and in the corporate world...Fraud=Termination.

The car is obviously NOT a GT model, despite the wheels. The guy works at a Nissan Dealer for Christ sake, how hard would it be for him to swap those on off another car? The dead give-a-way is the lack of brembos. When Nissan dealers run ur vin number your trim level shows in thier system. To be positive you have a Touring model (and not a GT that had the Brembos removed..who would do this?) contact the rep for Performance Nissan here on the boards, and ask him to run your VIN.

I'm SURE our advice is helpful to you, but in all honesty, it's going to take a laywer to know if you really have a case or not. Have your vin checked, call a laywer, and see what he says. If he says you have a case, and all you want is a set of Brembos to make you happy, LET THE LAYWER NEGOTIATE. He will know better than us what steps to take, and it's highly unlikely the store owner is going to try and bully him around.

DEFINATELY KEEP US POSTED! GOOD LUCK!

I have heard several stories where previous owners stripped a model of it's headlights, taillights, OEM brakes, OEM wheels, and basically anything that wasn't bolted onto the car worth money only to put on cheaper substitutes and part out the rest. Honestly, I think it happens a lot more often than people think, and they knowingly resell/trade the car to unsuspecting 3rd party buyers or dealerships.

You need to talk to multiple lawyers, not just one. Any documents stating what you are buying is basically a contract. They may pull "well you should have done the research". Either way, it shouldn't matter that you didn't do the research. If it says one thing and you got something else, that is considered false advertisement. They most likely will have to buy the car back. Not sure if it will be in full price, they may subtract the amount of miles you have driven it.

Everything also depends on how you approach them. If you act like you don't know anything, then they will try to scare you away. Stand your ground (be hard not rude) and have a lawyer handle it. Usually the lawyer will give them a call and let them know the circumstances and blab out a few laws. This will generally make them re-negotiate. Don't take the car washes and what not, in fact don't ever let a dealer touch your car unless something needs to be fixed under warranty (even then it's iffy).

I wouldn't argue with the lawyer on his fees and I ain't no lawyer...but there is no way this case requires anywhere close to 60 hours of research and court time. This is a matter that can probably be handled quickly in small claims court by you or any decent lawyer. No offense, but invest in some english classes, your life will be a lot easier and more profitable.
Small claims court has a limit of the amount you are suing for. Here in Seattle, I believe it is up to 2500. In cases involving higher amounts, negotiations between the two lawyers first then generally it goes to mediation. If not resolved, it goes to court. If it goes to court you will be spending some hard earned money. At this point, it may not be worth it, unless you are doing it to make a point.

And true, for a really good lawyer you may be looking at about that (300 per hour). Usually, if you go to a smaller office, they will hand it off to someone with less status. They charge less per hour because that individual has been there less than couple years. That doesn't mean that they won't work hard for you. They may work harder to show the partners that they can win cases. It's the only way to really move up. Start at the bottom and prove yourself.

And forget the classes. Make some friends that speak English well. I've learned that classes don't help unless you use it on a regular basis with ppl who are around you. Namely friends and family. I know this because the 3.5 yrs of Spanish went out the door. I didn't have anyone to talk to.

Get a friend or family member you trust that speaks English well to go with you to small claims court and have them represent you. You don't need to open your mouth. You save on the lawyer fees, and if you lose, what you lose is negligble.

Only problem with this approach is that even if you win and get brembos, the car is still a touring model no matter what you do with it. If you're ok with that, then go with small claims. If you're not, get a lawyer and try to get your entire purchase amount back.
I agree with you +1. I thought he was arguing for the right model, not just the brembo's. Having the wrong model will have an effect on the cost when selling in the future.
