hmm. are your car repairs at least under way? your insurance should just cover the damages and then worry about if it comes out of their pockets or the other insurance companies pockets later.

my car has not been repaired yet. they told me that if i wanted to get it repaired NOW that i have to loose the 750 deductible even though the other party is at fault. earlier today i was told to email the video to the other dudes insurance but then i got a call an hour later saying that i shouldnt.

i received a letter from my insurance stating that the accident was not my fault.

it wont be til a couple more days before this get sorted out.

ok update:
the other guy's insurance (liberty mutal) stil wont admit fault and would not pay for my damages. so my insurance company (farmers) is preceding into getting a lawyer to get back the money.

i got to loose the 750 deductible until they can get it back from liberty mutual which they say take 6 months.

i try contact liberty mutal but they dont respond to my phone calls. my agent called liberty mutual and still they dont answer. so they are just full of ****.
my insurance premium is not goinng go up cause of this...thank Goodness

an adjuster came out and said that it was only 2600 dollars worth in damages. which i dont think is enough to cover everything. he didnt look under the hood to see what else was damage so imma take it to a body shop to see how much total it would cost to see if that cover that too.

also video is back up. cause its useless to hide it now. my insurance guys saw it already.

100% the SUV's fault. It is ILLEGAL to cross a double yellow line clearly marked on the video.

how would this prove to the cop that you weren't speeding if there isn't a speedo shot?

actually i was going to set up a gps usb mouse to the carputer. i also have an overlay software set aside so that i could set it up sometime before thanksgiving.

i thought it was necessary after getting pulled over in july and got cited for speeding.

You are correct sir....that whole "you aren't legally allowed to cross a double yellow line" rule, assuming its the same there as it is up here in Canada

SUV took your right of way

They will lose in court if you show that, you should easily win, some insurance companies suck.

It did look like you were "speeding" given the circumstances of the cars in right lane basically stopped, I would have slowed down approaching the turn but you wanted to make the light so....

Also you can see the SUV start to move, you have to expect things like that. Drive like nobody can see you! I ride a motorcycle and it makes me super aware, if you were on a bike you'd be in some $hit

Not getting down on you, just sharing my thoughts, you will be a better driver due to this. Good luck.

Looks like his fault entirely. He did not have the right of way like others have said. He would only if it was at the light and it was green for him or a 4-way stop.

A lady once t-boned me in a parking lot (before I had my Z) and she drove right through a painted "Stop" marking on the surface of the parking lot. I was in the main lane and she was coming up an artery off the side. Her insurance (Mercury) basically told me and my ins company to pack sand so I filed a small claims action against her and I paid the extra $$ to have the county deputies serve her in person.

The very day she got served, Mercury called me, ready to settle. I wish I could have been there. I was hoping they got her at work or something in front of people....

I got paid $2500 for repairs to a car that wasnt worth $1000. Don't ask me how that happend, but it was sweet.

First...after accident, do not move your vehicle or other vehicle untill police gets there.
The thing is he tried cross double lane, but accident happend before he cross the double lane.

Did you get a police report? What insurance company do you have?

i wasnt speeding anytime before the accident or during the accident.

i have farmers insurance and the other guy got liberty mutual.

when the adjuster came out he only appraised $2600 for the damages which i know is not enough. because a descent repaint is somewhere up in the thousands if not high hundreds.

i did get a police report and its on here somewhere. and i might just file small claim. just dont feel like going thru months of waiting for the claim money to come in.

so should i file suit or just let my insurance company do it? since its clearly not my fault.

^ gotcha, one more question, any damage in under the hood?

You really have to stop by your local body shop first, my f/r bumper repaint cost 500 total.

Edit: if you need used headlight or oem bumper, keep your eyes on classifield. That will save you some money.

thats all i can see. im taking it to body shop tomorrow.

As for the double yellow line law, I think it's mainly no passing. but I know you can turn left into a driveway. And I assume u can turn into a highway as well by crossing a double yellow.

21460. (a) When double parallel solid lines are in place, no person
driving a vehicle shall drive to the left thereof, except as
permitted in this section.
(b) When the double parallel lines, one of which is broken, are in
place, no person driving a vehicle shall drive to the left thereof,
except as follows:
(1) That the driver on that side of the roadway in which the
broken line is in place may cross over the double line or drive to
the left thereof when overtaking or passing other vehicles.
(2) As provided in Section 21460.5.
(c) Either of the markings as specified in subdivision (a) or (b)
does not prohibit a driver from crossing the marking when (1) turning
to the left at any intersection or into or out of a driveway or
private road, or (2) making a U-turn under the rules governing that
turn, and either of the markings shall be disregarded when authorized
signs have been erected designating offcenter traffic lanes as
permitted under Section 21657.
