Default Valve Cover bolts over-torqued....what will need to be replaced

mileage: 102,500 extended warranty expires 10/24/2010 or 111,000
cliffs:
1. dealership performed valve cover replacement on drivers and passenger side valve cover gaskets(only drivers side had "blow by")

2. few weeks pass, smell burning oil, check it out and passenger side valve cover is leaking(100% positive it was not leaking before repair as valve cover and valve cover gasket were replaced 2 years ago)

3. return to dealer, ask them to tighten down the bolts as i have no tools with me as i am working in a city 2 hours away from home and staying at hotel

4. service advisor returns 30mins later and says someone over-torqued the bolts and that they can't tighten them. Ask me if i have messed with the car I reply "no" the car sits in a parking garage until the weekend when i go home

5. I ask service advisor if this repair is covered under their work they performed when changing the valve cover 32 days ago. he states they will have to look at it and see.

What is there to look at? cover was not leaking before repair, now it is. With the bolts being over-torqued and just turning now, what are possible repairs I may be facing if they don't honor their labor? any help is greatly appreciated.

I'm trying, but I can really sense their service manager is trying to put this off on me and that is really f*cked up, I would never purposely damage something like that in hopes of trying to get it fixed for free.

exactly, why in the world would you even touch it, if you paid to have it fixed in the first place...

escalate the issue past the service manager and two the dealership general manager...

thanks for the advice. I contacted Nissan North America consumer affairs and was told a regional person would contact me soon. I then informed the service manager of this contact and he now states he will cover the repair. go figure.
