Actually no, I'm not familiar with that one. I think I know what you're saying though. I'm not recommending everyone to go with the arbitration process, where you represent yourself. In fact, if someone doesn't have a technical understanding of the problem, as well as the ability to explain it in layman's terms to the arbitrator, then they probably won't stand much chance of winning. The Nissan rep will be able to bull**** their way to a win.

Remember, the BBB arbitration is an informal process, so the normal caveats of legal representation don't necessarily apply. You can even present evidence in support of your arguments that you might not be able to use in court. Also, not all LL attorney's are willing to do the "pay only if you win" thing. I personally haven't found any yet that will do that, but I did somewhat limit my search to the local area. I started out wanting to go straight to filing suit with a LL attorney representing me, but I now think I have a better chance and less risk with the arbitration process. Maybe if there were some better attorney's in my area, my decision would have been different, but living in a "small town" (and surrounded by the same) I don't have many choices.
Gary:
I believe within the LL there is a stipulation the defendant pays legal fees, they do not have choice. You may live in a small town, but an attorney specializing in LL within your state could represent you.
I am impressed that you want to take the time to work through this one yourself. My guess is you'll be facing an attorney representing Nissan.

I think you're right about the defendant paying legal fees if they lose. My wording probably wasn't the best...what I meant was that if I lost the case, then the attorney would require payment from me. This was the case with any that I contacted. I know there are plenty of attorneys out there that don't require any payment from their client for LL cases, they just aren't located in all areas.

Anyway...I'll definitely post up the results of my hearing for those that are interested. If I win, I'll go as far as saying that just about anyone can, because mine is a special case where Nissan representatives and dealers have been very dishonest in an effort to make me out to be the cause of the tire problems. They created an elaborate story, including claims that my entire warranty is void (yet according to NNA its fully intact), but I've done my homework and I'm well prepared to disprove their story if they try to use it at the hearing. I really can't wait to get this done, not only to rid myself of the problems but to get the satifsaction of beating them.

I was going to do the LL thing at first too, until I read through some of the posts on the site. I am confident that a LL claim would be successful, but will also take longer. With the BBB, I get a hearing in about 30 days. If it doesn't work, it only added 30 days to the process.

I think someone on the forum had Nissan agree to buy the car back before the hearing even happened.

Mark.

Got my extended tire warranty ( 2 year adjustment) from Nissan today. I have 2500 miles on the replacement tires that the dealer put on at 4400 miles. They are running smooth and even as if they were new. I hope this continues.

To add insult to injury - I just received my Tire notice in the mail. Thanks NNA - too bad I turned that POS in on 5/28. It just pisses me off that I even received the notice......

Yeah - I turned the Z in on Friday (28th) and got my $6800.00 check. Went and bought a Chevy Colorado LS Sport Crew Cab with Zero down, 1.9% for 60 months 2k rebate on Saturday (29th).

I know it's not a Z, but I do have my 1983 280zx in the garage having some body work done - so I didn't leave the "Z family". The truck drives really nice with the 17" wheels (235 50R17's - sound familiar?) & the sport suspension. Besides, my payments went down and I have all my settlement left to work on the 280zx if I want to. In the end it was a win/win.

And to top it off - NNA still owes me $447.74 which the "check" is in the mail.....

Is the BB a that everyone refers to this?

http://www.dr.bbb.org/autoline/alrules.asp#8

What is the net difference between BB and LL? I want to dump my car (on NMA) soon. I will also read the 1000 posts here. Thanks.

The LS Sport was 26k out the door (tax, tag, rebate, etc). It's a 220hp RWD I5 - which responds really well, so I'm quite impressed with the power. Granted it's no Z in that area, but has other perks the Z didn't..... Like storage!

LOL

I got the truck "need" a few years ago and bought a new 2002 Dodge 1 ton dually 4x4 with a Cummins turbo diesel, 6 speed manual. Listed for $36K and I bought it for $28.5K, now that was a beast

You know what kills me - I've seen the five other Brickyards in Jacksonville over the past 2 weeks. I can't even "beep" and wave any more.....

Gary K, (aka know-it-all) I'm also somewhat of a Know-it-All, and I prowud to know you. I believe is in avoiding lawyers If possible and wish you luck in thecase. I went the bbb route as well and understand that you can always revert to LL in court. Then you can get a lawyer. I was very skeptical during the process because the BBB seemed to be partial but the arbitor was very objective and, in the end, wrote up a very good award. I frankly think you are representing a pretty sharp client and beleive that more people should take up the sword of right and speak up for themselves. Good luck and someday hope to see you in another Z when they finally get around to straightening out this tire/suspension issue.

If you follow the lemon law process in FLA - you have to go though the BBB Autoline 1st. It's slow, but free.

Thanks for the kind words. You're right, if the BBB process fails then I can still get a lawyer and go to court. I'll have time too, before the lemon law timeframe runs out, because I just got word that my hearing is at the end of this month! I really like this car, but the problem with the tires is one that I can't live with. Mine has some of the other problems too, but I've never taken it in to get those fixed because they just aren't nearly as much of an issue. It'll be very interesting to see what the outcome of my case is, and I'll disclose why later on along with more information.

How does one go about getting the extended warranty for the tires. I have not read back in the forum enough to figure it out and figured a quick question and answer to the issue for me!!!!!!

Thanks for your help.
